بیانیه جمعی از وکلای دادگستری و فعالین مدنی کرمانشاه در اعتراض به احکام صادر شده در پرونده‌های «حجاب»

کیهان نوین: در چند روز اخیر احکامی از برخی محاکم دادگستری علیه زنان به ویژه بانوان هنرمند صادر شده که حاصل و نتیجه‌ای جز بی‌اعتباری و وهن نظام قضائی کشور نداشته است.

دستگاه قضائی باید به دور از هر نوع گرایش سیاسی و ایدئولوژیک، صرفا بر اساس قانون به اتهام افراد رسیدگی و حکم صادر کند.

ظهور آشکار تمایلات سیاسی و ایدئولوژیک در آراء محاکم قضائی نه تنها در پیشگاه جامعه عدم استقلال قضات و دستگاه قضایی را به تصویر می‌کشد بلکه منجر به بی‌اعتمادی بیشتر مردم به قوه قضاییه و بی‌اعتباری آراء محاکم در جامعه خواهد شد.

فلسفه تعیین مجازات‌های تکمیلی و جایگزین، تغییر رویکرد از سیاست مجازات‌محور و عدالتِ‌ کیفری به رویکرد عدالتِ ترمیمی و مساعدت در حق متهمین است، اما در آرائی که اخیرا علیه بانوان هنرمند صادر شده با نقض این منظور اصلیِ قانونگذار، از مجازات‌های جایگزین در جهت تحقیر افراد استفاده شده است.

بدیهی است که جامعه با درک واقعی اتفاقات رخ داده اخیر، نگاه تحقیرآمیز و پیکان مواخذه خود را به سمت دستگاه قضائی می‌چرخاند که با صدور احکامی اینچنین، اعتبار و شرافت دستگاه قضایی را در مخاطره جدی قرار داده است.

می‌خواهند بلایی که کج‌سلیقگی‌ها بر صداوسیما نازل کرد و آن را در میان جامعه مطرود و متروک نمود را برای دستگاه قضائی نیز تکرار کنند.

عرصه حقوق، عدالت و نظام قضائی آوردگاه کینه‌توزی و تحقیر نیست، از این رو لازم و بایسته است که مسئولین دستگاه قضائی با تحلیل درست وقایع جامعه، مانع چنین رخدادهای ناگوار شده و از بروز و ظهور تمایلات سیاسی و ایدئولوژیک در متن احکام قضایی جلوگیری کنند تا ته‌مانده اعتبار و شرافت دستگاه‌قضائی در مهلکه این بی تدبیری ها نابود نگردد.
