خبرگزاری هرانا با تأکید بر اینکه این پرونده در دوران حبس و در حالی که منوچهر بختیاری در زندان بوده علیه او گشوده شده، نوشته که در تاریخ بیست و نهم مهرماه سال جاری، جلسه رسیدگی به اتهامات منوچهر بختیاری به صورت ویدئوکنفرانس در همان شعبه برگزار شده بود.

همسر منوچهر بختیاری با اعلام حکم جدید علیه منوچهر بختیاری به خبرگزاری «هرانا» گفته که «بیش از یک سال و نیم پیش، پزشکی قانونی نامه‌ای مبنی بر عمل فوری فتق و پروستات همسرم را تأیید کرده است. همچنین بیش از سه ماه است که از درد دندان رنج می‌برد، اما با بهانه تراشی مسئولین مربوطه از رسیدگی درمانی تخصصی و اعزام به مرخصی درمانی محروم مانده است.»

پیشتر اعلام شده بود که پرونده جدیدی علیه منوچهر بختیاری با شکایت آقای لک، رئیس اطلاعات زندان قزوین، تشکیل و به قوه قضاییه ارجاع شده بود.

منوچهر بختیاری پس از کشته شدن پویا فرزند ۲۷ ساله‌اش در اعتراضات سراسری آبان ۹۸ که در مهرشهر کرج از ناحیه سر مورد اصابت شلیک مأموران جمهوری اسلامی قرار گرفت به دادخواهی فرزند برخاست. خانواده بختیاری طی چهار سال گذشته بارها بازداشت، احضار و تهدید شده‌اند.

منوچهر بختیاری آخرین بار در تاریخ ۹ اردیبهشت‌ماه ۱۴۰۰، توسط نیروهای امنیتی همراه با ضرب و جرح در منزل شخصی خود در تهران بازداشت شد. او نهایتا توسط دادگاه انقلاب به ۳ سال و ۶ ماه حبس، ۲ سال و ۶ ماه تبعید و ۲ سال ممنوعیت خروج از کشور محکوم شده و از بازداشتگاه یکی از نهاد‌های امنیتی به ندامتگاه مرکزی کرج منتقل شد.

وی روز چهارشنبه ۲۹ تیر بدون اطلاع قبلی به زندان قزوین منتقل شد. علی شریف‌زاده وکیل منوچهر بختیاری ۳۰ تیرماه امسال خبر داده بود که موکلش «با توجه به شرایط جسمانی» و «خون‌ریزی دستگاه گوارش» به مراقبت و درمان نیاز دارد.

تیرماه پارسال نیز گزارش شده بود که منوچهر بختیاری پیشتر با وجود ابتلا به بیماری های کلیوی، پروستات و فتق و با وجود تاییدیه پزشکی قانونی مبنی بر نیاز جدی به اقدامات درمانی، از رسیدگی پزشکی تخصصی و اعزام به مرخصی درمانی محروم مانده است.

منوچهر بختیاری دی‌ماه ۱۴۰۰ پس از مطلع شدن از صدور حکم غیرقانونی زندان، دست به اعتصاب غذا زد. او به سلول انفرادی منتقل شد اما پیش از انتقال در نامه‌ای اعلام کرد که «این دادخواهی خاموش شدنی نیست» و «دستوردهندگان و انجام‌دهندگان این جنایت مطمئن باشند به‌ زودی در دادگاه ملت ایران محاکمه و به سزای اعمال خویش خواهند رسید.»

این پدر دادخواه جدا از تبعید به زندان مرکزی قزوین، مدت‌ها در این زندان در سلول انفرادی بسر برده و به بند عمومی هم منتقل نشد. دی‌ماه سال گذشته نیز گزارش شد که این زندانی دادخواه مورد فحاشی و ضرب و جرح مأموران زندان قرار گرفته است.

صبا بختیاری خواهر منوچهر بختیاری که چند ماه پیش از ایران خارج شده، اردیبهشت ۱۴۰۲ در گفتگو با «کیهان نوین» درباره آخرین وضعیت برادرش گفته بود که «همانطور که می‌دانید برادرم تقریبا دو سال پیش در اردیهشت‌ماه برای چندمین بار دستگیر شد و از آن زمان تا الان بدون یک روز مرخصی در زندان است. اوایل پنج شش ماه در بند اطلاعات بود که ما نمی‌دانیم در کدام زندان نگهداری می‌شد. پنج شش ماه دیگر در زندان مرکزی کرج بود و از تابستان سال گذشته به زندان «چوبیندر» قزوین تبعید شده و از آن زمان تا الان در سلول انفرادی و ممنوع‌الملاقات است. از آبان سال گذشته (۱۴۰۱) تا یک ماه قبل از نوروز ممنوعیت تماس هم داشت. از اسفند روزی دو دقیقه به او اجازه تماس دادند اما به دلیل پیام نوروزی که فرستاد، اجازه تماس را دوباره قطع کردند. به تازگی هم برادرم برای گرفتن اجازه تماس اعتصاب غذا کرد و برای بیماری‌هایی که در زندان به آنها مبتلا شده، حالش با اعتصاب غذا وخیم شد و به او اجازه روزی دو تا سه دقیقه تماس تلفنی دادند.»

صبا بختیاری همچنین گفته بود که روده برادرش «به خاطر اعتصاب‌هایی که در این چند سال انجام داده سوراخ شده. مشکل فتق پیدا کرده و یکی از دستانش برای مدتی مقطع لمس شده بود. یکبار در سال گذشته دکترها نامه نوشتند که ایشان باید هر چه سریع‌تر به بیمارستان منتقل و تحت عمل جراحی قرار بگیرد اما متأسفانه حکومت به این درخواست پزشکان اهمیت نداده و حتی با وثیقه شش میلیارد تومانی که برای مرخصی درمانی او تعیین کردند و ما حاضر شدیم این وثیقه را بگذاریم، باز هم ممانعت کردند.»

عمه پویا بختیاری افزوده بود که «تابستان سال گذشته یکبار وقتی برادرم از داخل زندان توسط وکیل‌اش برای دادرسی به دیوان عالی کشور نامه داده بود، چندین ماه پرونده در دیوان عالی کشور بررسی و حکم آزادی ایشان از سوی دیوان عالی کشور صادر شد و خود من هم نزدیک به چهار ماه به دیوان می‌رفتم و می‌‎آمدم؛ ما حکم آزادی او را گرفتیم اما دادستان کرج، آقای مددی، و وزارت اطلاعات باز هم از آزادی ایشان جلوگیری کردند. این موضوع در خرداد ۱۴۰۱ بود و مصادف شد با دستگیری ناهید شیرپیشه و برادر دیگرم مهرداد بختیاری. این اقدام اصلا قانونی نبود چون فکر می‌کنم در تمام کشورها دیوان عالی آن کشور بزرگترین و بالاترین مرجع قضائی است و وقتی حکمی صادر می‌کند، دیگر آن حکم قطعی است و دیوان عالی حکم آزادی برادر مرا صادر کرد ولی متأسفانه اینها از یک ماده که در قانون وجود داشت استفاده کردند و به شخص رئیس قوه قضاییه نامه دادند و او حکم آزادی برادرم را لغو کرد!»

صبا بختیاری ادامه داده بود که «زمستان گذشته وقتی که ۲۲ بهمن به خیلی از زندانی‌های سیاسی عفو خورد، برادر من هم شامل عفو شد و دوباره دو ماه اینها ما را بازی دادند و آزادش نکردند. گرچه ما همه می‌دانستیم حاضر به آزاد کردن او نیستند و حتی خود برادرم از زندان می‌دانست اینها دروغ می‌گویند؛ اما اینها آدم را در وضعیتی قرار می‌دهند که می‌دانی دارند بازی‌تان می‌دهند اما باز پیگیری می‌کنی چون فکر می‌کنی اگر ادعایشان واقعی باشد و تو پیگیر نشوی، آنوقت تویی که کوتاهی کرده‌ای! به خاطر همین دو ماه دیگر ما را بازی دادند ولی خب متأسفانه پرونده‌های جدیدی علیه برادرم باز کردند و ایشان آزاد نشد و مثل تابستان گذشته باز هم دادگاه انقلاب کرج، و شخص آقای مددی، و وزارت اطلاعات جلوی آزادی او را گرفتند.»
