اتهامات سنگین توماج صالحی: «افساد فی‌الارض»، «همکاری با دول متخاصم»، «تبلیغ علیه نظام» و «دعوت به اغتشاش»

وکیل توماج صالحی از برگزاری دومین جلسه دادگاه این هنرمند در روز یکشنبه ۱۱ تیرماه خبر داده و چهار مورد از عناوین اتهامی او را «افساد فی‌الارض»، «همکاری با دول متخاصم»، «فعالیت تبلیغی علیه نظام»، و «دعوت به اغتشاش» عنوان کرده است.

توماج صالحی خواننده رپ ایرانی در جریان اعتراضات جنبش ملی و در آبان ۱۴۰۱ بازداشت شد و اکنون با اتهام سنگین «افساد فی الارض» در خطر صدور حکم اعدام قرار دارد.

امیر رئیسیان وکیل توماج صالحی گفته که «افساد فی‌الارض، همکاری با دول متخاصم، فعالیت تبلیغی علیه نظام و دعوت به اغتشاش، از اتهامات توماج است اما حجم اتهامات فراتر از این بود که در نیم ساعت مقرر در ملاقات با توماج حتی بتوانیم یک‌یک اتهامات را برای موکل تبیین کنیم.»

امیر رئیسیان در گفتگو با روزنامه «هم‌میهن» گفته دادسرا مدعی است که موکلش با انتشار توییت‌هایی مرتکب «نشر اکاذیب» به‌ شکل گسترده و در نهایت موجب «افساد فی‌الارض» شده است.

به گفته این وکیل دادگستری اتهام دیگر توماج صالحی مصاحبه با رسانه سی‌بی‌سی که یک رسانه کانادایی است، مصداق «همکاری با دولت کانادا» تلقی شده و از آنجا که دولت کانادا از نظر دادسرای اصفهان «دولت متخاصم» محسوب می‌شود، در نتیجه این مصاحبه مصداق همکاری با دولت متخاصم تلقی شده است.

امیر رئیسیان «دعوت مردم به بیان خواسته‌ها و مطالبات خودشان» را از دیگر مصادیقی عنوان کرده که از سوی دادگاه «دعوت به آشوب و اغتشاش» نامیده شده و افزود که  «فعالیت تبلیغی علیه نظام جمهوری اسلامی» و «توهین به بنیانگذار انقلاب و رهبری نظام» و «اخلال در نظم» و «نشر اکاذیب» هم به‌ عنوان اتهامات توماج صالحی به او تفهیم شده است.

این وکیل دادگستری همچنین گفته که «دادگاه به ریاست آقای براتی برگزار و در نهایت ختم رسیدگی از سوی دادگاه اعلام شد؛ بر این اساس دادگاه مبادرت به صدور رای خواهد کرد و تصمیم دادگاه بر اساس قانون در یک هفته به ما ابلاغ خواهد شد.»

امیر رئیسیان با تأکید بر اینکه تنها توانسته نیم ساعت با موکل خود در بازداشتگاه اطلاعات اصفهان ملاقات کند گفته «حجم اتهامات فراتر از این بود که در این نیم ساعت حتی بتوانیم یک‌یک اتهامات را برای موکل تبیین کنیم.»

او همچنین افزوده که «دادگاه توماج در شعبه اول دادگاه انقلاب اسلامی اصفهان دو هفته پیش در ۲۸ خرداد آغاز شده بود اما با توجه به ناتمام ماندن موضوعات مطرح شده در جلسه رسیدگی، تنفس اعلام شد و ادامه رسیدگی به روز یکشنبه ۱۱ تیرماه موکول شده بود.»

وکیل توماج صالحی گفته که «روند جلسه از نظر رعایت تشریفات دادرسی مطابق جلسات دیگری که در این شعبه برگزار می‌شود غیر علنی بود و اجازه حضور اشخاص ثالث و خبرنگاران یا نمایندگان جامعه مدنی و همینطور خانواده موکل در دادگاه داده نشد.»

او توضیح داده که «پیش از این در راستای اجرای ماده ۳۸۷ قانون دادرسی کیفری به ما اعلام شده بود که ایرادات خود را در رابطه با روند تحقیقات دادسرا و نقایص پرونده اعلام کنیم و پس از اعلام ما دادگاه با پذیرش ۶ ایراد درباره اتهامات و همین‌طور دو ایراد بنیادی در روند تحقیقات، قرار رفع نقص صادر و پرونده را برای دادسرا جهت رفع نقایص ارسال کرده بود که دادسرا تنها در رابطه با یکی از ایرادات ما را احضار کرد و سایر ایرادات را رفع نشده باقی گذاشت. البته با ارائه توضیحاتی که موجب رفع نقایص نبود پرونده را به دادگاه مرجوع کرد.»

اسدالله جعفری رئیس دادگستری استان اصفهان ششم آذرماه و یک ماه پس از بازداشت توماج صالحی اتهامات او را «افساد فی‌الارض از طریق نشر اکاذیب به صورت گسترده، فعالیت تبلیغی علیه نظام، تشکیل و اداره دستجات غیرقانونی به قصد برهم زدن امنیت کشور» اعلام کرده بود.

وی افزوده بود که توماج صالحی به همکاری با «دولت متخاصم علیه جمهوری اسلامی» و «نشر اکاذیب و تشویش اذهان عمومی از طریق فضای مجازی و تحریک و ترغیب افراد به اعمال خشونت‌آمیز» هم متهم شده است.

توماج صالحی خواننده رپ ایرانی در جریان اعتراضات جنبش ملی و در آبان ۱۴۰۱ بازداشت شد. چند روز پس از بازداشت توماج صالحی ویدئوی کوتاهی توسط «باشگاه خبرنگاران جوان» وابسته به صداوسیمای جمهوری اسلامی منتشر شد.

در این ویدئوی کوتاه که هنوز مشخص نیست واقعا توماج بود یا نه، فردی که چشم‌بند پهنی دارد و روی زمین نشسته، می‌گوید اشتباه کرده است. این ویدئو نیز مانند ویدئویی که امروز منتشر شد مطلقا مورد توجه افکار عمومی قرار نگرفت و فقط بر خشم و انزجار عمومی از جمهوری اسلامی افزود.

همچنین یکماه پس از بازداشت توماج صالحی خبرگزاری «تسنیم» نزدیک به سپاه پاسداران ویدئویی ۴۵ ثانیه‌ای از «اعترافات اجباری» توماج صالحی منتشر کرد.

سناریوی این ویدئوی اعترافات اجباری به شکلی است که توماج در اتاقی تاریک مقابل فردی که چهره‌اش مشخص نیست و نقش «بازجو» را به عهده دارد نشسته و از اقدامات خود ابراز ندامت می‌کند و با لبخند تلخی می‌گوید: «کاش می‌تونستم برعکسش را تولید کنم!»

متن منتشر شده به همراه این ویدئو در خبرگزاری «تسنیم» حاوی اتهامات سنگین علیه توماج صالحی بود. این خبرگزاری نوشته بود که «توماج صالحی در اتفاقات اخیر در صفحه توئیتر خود به تبلیغ خشونت و درگیری با نیروهای مسلح و ساخت کوکتل مولوتف می‌پرداخت و اخبار جعلی منتشر می‌کرد. او همچنین با انتشار فراخوان‌های مختلف برای شهرهای کشور در تبلیغ اغتشاشات نقش داشت.»

توماج صالحی از جمله هنرمندانی بوده که همواره در اظهارات خود کنار مردم ایستاده است. اکنون صدور اتهام سنگین «افساد فی الارض» که در قوانین جمهوری اسلامی اشّد مجازات آن «اعدام» است خطر صدور چنین حکمی را علیه توماج نیز به همراه دارد. به ویژه آنکه در پرونده سنگینی که از سوی سازمان اطلاعات سپاه پاسداران (ساس) علیه توماج تهیه شده، اتهامات سنگین دیگری نیز علیه این جوان هنرمند مطرح است.

توماج صالحی پیشتر در شهریور ۱۴۰۰ نیز بازداشت و به «تبلیغ علیه نظام» و «توهین به رهبر جمهوری اسلامی» متهم شده بود. وی حدود ده روز در بازداشت بود و سپس با قرار کفالت از زندان آزاد شد. این هنرمند برای آن پرونده در دادگاه به شش ماه زندان محکوم شد که اجرای حکم یک سال به تعلیق درآمده بود.

Tomaj Salehi is one of the artists who always stands by the people in his statements. Now issuing a heavy charge of “corruption on earth”, which is the most severe punishment in the laws of the Islamic Republic of Iran, carries the risk of issuing such a sentence against Tomaj as well. Especially, in the serious case prepared by the Intelligence Organization of the Islamic Revolutionary Guard Corps (IRGC) against Tomaj, there are other serious charges against this young artist.

Tomaj Salehi was arrested earlier in Shahrivar 1400 and accused of “propaganda against the regime” and “insulting the leader of the Islamic Republic”.
