سه محکوم پرونده «خانه اصفهان» همچنان با خطر «اعدام» روبرو هستند

افزایش نگرانی از احتمال اعدام سه جوانی که در سناریوی نهادهای امنیتی در پرونده معروف به «خانه اصفهان» محکوم شدند، شهروندان و خانواده‌ آنها شامگاه گذشته مقابل زندان دستگرد اصفهان تجمع کردند.

این سه جوان پیشتر در پرونده معروف به «خانه اصفهان» و با سناریوسازی نهادهای امنیتی محکوم به اعدام شدند. حکم اعدام این سه جوان در دیوان عالی تأیید شده و اکنون آنها در خطر اجرای حکم اعدام قرار دارند.

روز گذشته مقامات امنیتی و قضایی به خانواده مجید کاظمی گفته بودند که این سه متهم در روزهای آینده اعدام خواهند شد. برخی منابع نزدیک به خانواده هم از خطر اعدام این سه جوان در سحرگاه دوشنبه ۲۵ اردیبهشت ۱۴۰۱ خبر داده بودند.

این اخبار سبب تجمع خانواده‌ها و شماری از شهروندان در مقابل زندان دستگرد اصفهان شد. در این تجمع مردم شعارهایی چون «این آخرین پیامه، اعدام کنی قیامه» سر دادند. شماری از شهروندان نیز در خیابان‌های اطراف زندان با زدن بوق‌ ممتد و ایجاد راه‌بندان‌ اعتراض خود را به اجرای احتمالی حکم اعدام این سه جوان نشان دادند.

مأموران جمهوری اسلامی برای پراکنده کردن تجمع‌کنندگان به سوی آنها گاز اشک‌آور شلیک کردند.

شاهزاده رضا پهلوی نیز شامگاه یکشنبه با انتشار توئیتی به زبان‌های فارسی و انگلیسی درباره خطر اعدام این سه جوان نوشت: «جان سعید یعقوبی، صالح میرهاشمی و مجید کاظمی در خطر فوری است. در این لحظات که خانواده‌های نگران این سه معترض زندانی در مقابل زندان دستگرد اصفهان هستند، از هم‌میهنان در اصفهان و شهرهای نزدیک می‌خواهم که به آنها بپیوندند. اجازه ندهیم که ضحاک جوان‌کش و عواملش جان‌های بی‌گناه دیگری را بگیرند و مادران دیگری را سوگوار کنند.»

منابع نزدیک به خانواده این زندانیان ساعاتی پیش اعلام کردند سحرگاه دوشنبه حکم اعدام اجرا نشده اما دستوری برای توقف اجرای حکم هم صادر نشده است و در نتیجه همچنان خطر اجرای حکم در روزهای آینده وجود دارد. به ویژه آنکه رژیم در مقابل اعتراضات کمی عقب‌نشینی می‌کند و بعد از مدتی متهمانی را که در بیدادگاه آن محکوم شده‌اند، به چوبه دار می‌سپارد.

سازمان عفو بین‌الملل نیز جمعه گذشته در بیانیه‌ای هشدار داده بود که مجید کاظمی، صالح میرهاشمی و سعید یعقوبی، سه معترض بازداشت شده در پرونده محله «خانه اصفهان» پس از اقدام دیوان عالی کشور در «تایید احکام ناعادلانه اعدام‌شان»، اکنون «در معرض خطر قریب الوقوع اعدام» قرار دارند.

در این بیانیه، عفو بین‌الملل با اشاره به اینکه مجید کاظمی، صالح میرهاشمی و سعید یعقوبی در جریان اعتراضات پس از کشته شدن مهسا امینی، در اصفهان بازداشت شده‌اند، افزود: «آنها در آبان ماه بازداشت شدند و محاکمه برگزار شده برای آنها در اواخر آذر و اوایل دی ماه ۱۴۰۱، به شدت ناعادلانه بوده است.»

عفو بین‌الملل همچنین تاکید کرد که مجید کاظمی در یک فایل صوتی که از زندان مرکزی اصفهان به بیرون ارسال کرده، گفته که از زمان بازداشت برای اخذ «اعتراف اجباری» تحت شکنجه و خشونت مکرر از جمله ضرب و شتم قرار گرفته است.

عفو بین‌الملل همچنین تاکید کرد که سعید یعقوبی، مجید کاظمی و صالح میرهاشمی از هنگام بازداشت تاکنون از دسترسی به وکیل انتخابی محروم بوده‌‌اند و وادار به «اعترافات اجباری» شده‌اند.

پیشتر فایلی صوتی از مجید کاظمی منتشر شده که او در تماس تلفنی از زندان در تاریح ۲۳ دی تأکید می‌کند که با شکنجه‌های وحشیانه جسمی روبرو بوده و حتی او را به یک باغ برده‌ و قصد تجاوز با باتوم به وی داشتند. او بر اثر ضرب و جرح و شکنجه ناچار به اعتراف اجباری شده اما در دادگاه به قاضی گفته که از او اعتراف اجباری گرفته شده است.

بر اساس این فایل صوتی، مأموران امنیتی و بازجوها بارها مجید کاظمی را تهدید کردند که او را به همراه دو برادر دیگرش (که بازداشت نبودند) به دار خواهند آویخت. همچنین به او گفته‌اند مادرش در بیمارستان بستری شده است. او را زیر ضرب و جرح شدید قرار داده بطوری که روزی که بازداشت شد حدود ۹۰ کیلوگرم وزن داشت و تا روز دادگاه وزن او به حدود ۵۰ کیلوگرم رسیده بود.

مجید کاظمی تأکید کرده که «من هیچکاره بودم، از زمان بازداشت همه‌اش زیر شکنجه بوده‌ام، نه اسلحه‌ای داشتم، نه کاری کردم، و همه‌اش را زیر شکنجه گفتم.»

هفته گذشته و در روز سه‌شنبه ۱۹ اردیبهشت ۱۴۰۲ حساب کاربری «دادبان» در توئیتر که به معترضان مشاوره‌ حقوقی می‌دهد اعلام کرد حکم اعدام سه متهم پرونده «خانه‌ اصفهان» در دیوان عالی کشور تأیید شده است.

«دادبان» گزارش داده بود که در دادگاه بدوی متهم ردیف اول سید صالح میر هاشمی به دو فقره اعدام، متهم ردیف دوم مجید کاظمی شیخ شبانی به یک فقره اعدام و ده سال حبس تعزیری و متهم ردیف سوم سعید یعقوبی کرد سفلی به یک فقره اعدام و ده سال حبس تعزیری محکوم شدند.

پرونده «خانه اصفهان» مرتبط با مرگ سه نیروی آتش به اختیار و سرکوبگر جمهوری اسلامی در اعتراضات روز ۲۵ آبان ۱۴۰۱ است که عضو پایگاه بسیج محله «خانه اصفهان» معرفی شده‌اند.

در جریان این پرونده سید صالح میرهاشمی به «محاربه» از طریق کشیدن سلاح کمری، مجید کاظمی شیخ شبانی به «محاربه» از طریق کشیدن سلاح کلاشنیکف، و سعید یعقوبی کرد سفلی به «محاربه» از طریق کشیدن اسلحه متهم شدند.

بر اساس دادخواست تنظیم شده در این پرونده، مقامات امنیتی و قضایی مدعی شدند که مرگ محسن چراغی، محسن حمیدی و محمد کریمی سه نیروی سرکوبگر جمهوری اسلامی طی یک اقدام «تروریستی» صورت گرفته است.

دادبان با انتشار خبر تأیید حکم اعدام صالح میرهاشمی، مجید کاظمی و سعید یعقوبی نوشته بود که «جان این سه عزیز محبوس به شدت در خطر اعدام است، تا دیر نشده صدایشان باشیم» آمده که «در این پرونده، هیچ شواهد و مدارکی در پرونده بجز اعترافات اجباری متهمان علیه خود و یکدیگر وجود ندارد. حتی تصویر محل حادثه نیز هیچ چیزی را نشان نمی‌دهد. متهمان صرفا افرادی هستند که در صحنه اعتراضات آن شب حضور داشته‌اند. هیچکدام نپذیرفتند که به سوی ماموران تیراندازی کرده‌اند. تنها مستند تیراندازی متهمان به سوی مأموران اعترافات اجباری آنها علیه یکدیگر است. حتی علیه خود نیز اعتراف اجباری نکردند که در تیراندازی نقش داشته‌اند.»

مقامات قضایی و امنیتی مدعی بودند که متهمان پرونده ساعت ۲۱ از موتور پیاده شده نیروها را به رگبار بسته و محل را ترک کرده‌اند. دادستانی برای این ادعایش مدارکش را ارائه می‌دهد. این مدارک تصاویریست از دوربین مداربسته‌ی مغازه‌ای در منطقه‌ی خانه اصفهان که به ادعای دادستانی به وسیله‌ی این مدارک اثبات می‌شود این چند متهم دو بسیجی و یک نیروی فراجا را به قتل رساندند!

اما تصاویر دوربین مداربسته فقط نشان می‌دهند که چند نفر در کنار خیابان ایستاده‌اند و با یکدیگر صحبت می‌کنند. در این تصاویر نه خبری از تیراندازی است نه اسلحه‌ای دیده می‌شود! درواقع برعکس ادعای دادستانی، چنین تصاویری می‌توانند به عنوان مدرک بی‌گناهی این افراد ارائه شوند!

نکته‌ی دیگر راجع به این تصاویر از دوربین مداربسته این  است که تصویر اولی که نشان می‌دهند ساعت ۲۱:۴۶ دقیقه را نشان می‌دهد و تصویر دوم از همان محل و افراد ساعت ۲۲:۰۹ دقیقه را. حتی اگر افراد حاضر در دوربین مداربسته واقعا این متهمان باشند باز با سناریوی ارائه شده همخوانی ندارد! چرا که دوربین مداربسته‌ نشان می‌دهد ساعت ۲۲:۰۹ دقیقه این چند نفر در خیابان در حال صحبت کردن بودند. بعد بنا بر این ادعا سوار موتور می‌شوند، کمی دورتر از موتور پیاده می‌شوند، به سمت دیگر خیابان می‌دوند، نیروها را به رگبار می‌بندند، برمی‌گردند، سوار موتور می‌شوند، فرار می‌کنند و بنا بر تصویر دوربین مداربسته از محل دوم، در ساعت ۲۲:۱۳ به خانه‌شان در منطقه دیگری می‌رسند!

اینهمه نشان می‌دهد مانند بسیاری از پرونده‌های مشابه که در اعتراضات سال گذشته با سناریوسازی نهادهای امنیتی و قضایی ساخته شد تا چند شهروند را به چوبه اعدام بسپارند، مستندات پرونده یا اعترافات اجباری و زیر شکنجه وحشیانه متهمان بوده که در جلسه دادگاه هم تکذیب شده، و یا صرفا وجود یک یا دو تصویر از دوربین‌های مداربسته که مطلقا نشان‌دهنده ارتکاب جنایت یا تخلف از سوی متهمان نیست!

This news caused families and a number of citizens to gather in front of Dastgerd prison in Isfahan. In this gathering, people chanted slogans such as “This is the last message, execute the uprising.” A number of citizens also protested the possible execution of these three young men in the streets around the prison by honking their horns continuously and creating roadblocks.

The officers of the Islamic Republic fired tear gas to disperse the protesters.

Prince Reza Pahlavi also tweeted on Sunday evening in Persian and English about the danger of execution of these three young men: “The lives of Saeed Yaqoubi, Saleh Mirhashmi and Majid Kazemi are in immediate danger. At this moment, when the worried families of these three imprisoned protesters are in front of Dastgerd prison in Isfahan, I ask my compatriots in Isfahan and nearby cities to join them. “Let’s not let Zahak and his agents take other innocent lives and make other mothers mourn.”

Sources close to the families of these prisoners announced a few hours ago that the death sentence has not been executed, but no order has been issued to stop the execution of the sentence, and as a result, there is still a risk of the execution of the sentence in the coming days. Amnesty International also warned in a statement last Friday that Majid Kazemi, Saleh Mirhashmi and Saeed Yaqoubi, the three protesters arrested in the “Khane Isfahan” neighborhood case, after the action of the Supreme Court in “confirming their unjust execution sentences”, are now “at risk” are in imminent danger of execution.

In this statement, Amnesty International pointed out that Majid Kazemi, Saleh Mirhashmi and Saeed Yaqoubi were arrested in Isfahan during the protests after the killing of Mehsa Amini, adding: “They were arrested in November and the trial held for them in late December and early January 1401 was extremely unfair.

Amnesty International also emphasized that Majid Kazemi, in an audio file he sent out from Isfahan Central Prison, said that since his arrest to obtain a “forced confession”, he has been subjected to repeated torture and violence, including beatings.

Amnesty International also emphasized that Saeed Yaqoubi, Majid Kazemi and Saleh Mirhashmi have been denied access to a lawyer of their choice since their arrest and were forced to make “forced confessions”.

Earlier, an audio file of Majid Kazemi was published, in which he confirmed in a phone call from prison on December 23 that he faced brutal physical torture and even took him to a garden and tried to rape him with a baton. He was forced to confess due to assault and torture, but he told the judge in court that he was forced to confess.

According to this audio file, security officers and interrogators repeatedly threatened Majid Kazemi that they will hang him along with his other two brothers (who were not arrested). He was also told that his mother was hospitalized. He was severely beaten so that on the day he was arrested, he weighed about 90 kg, and by the day of the trial, his weight had reached about 50 kg.

Majid Kazemi emphasized that “I was useless, I have been under torture since my arrest, I did not have a weapon, I did not do anything, and I said everything under torture.”

Last week, on Tuesday, May 9, 1402, the “Dadban” account on Twitter, which provides legal advice to protesters, announced that the death sentence of the three defendants in the “Isfahan House” case had been confirmed by the Supreme Court.

“Dadban” had reported that in the trial court, the first-tier accused Seyed Saleh Mir Hashemi was sentenced to two counts of death, the second-tier accused Majid Kazemi Sheikh Shabani was sentenced to one count of death and ten years of imprisonment, and the third-tier accused Saeed Yaqoubi was sentenced to one count of death. And they were sentenced to ten years of imprisonment.

The case of “Isfahan House” is related to the death of three firemen under the control and repressive of the Islamic Republic during the protests on November 25, 1401, who were introduced as members of the Basij base in “Khane Isfahan” neighborhood.

In the course of this case, Seyyed Saleh Mirhashmi was accused of “warfare” by drawing a waist weapon, Majid Kazemi Sheikh Shabani was accused of “warfare” by drawing a Kalashnikov weapon, and Saeed Yaqoubi Kurd Safeli was accused of “warfare” by drawing a gun.

According to the petition filed in this case, the security and judicial authorities claimed that the death of Mohsen Chiraghi, Mohsen Hamidi and Mohammad Karimi, three repressive forces of the Islamic Republic, was a “terrorist” act.

When publishing the news confirming the death sentence of Saleh Mirhashmi, Majid Kazemi and Saeed Yaqoubi, he wrote that “the lives of these three dear prisoners are in serious danger of execution, we should be their voice before it’s too late” and that “in this case, there is no evidence in the case.” There is nothing except forced confessions of the accused against themselves and each other. Even the picture of the scene does not show anything. The defendants are only people who were present at the scene of protests that night. None of them admitted that they shot at the officers. The only documentation of the defendants shooting at the officers is their forced confessions against each other. Even against themselves, they did not force a confession that they were involved in the shooting.”

The judicial and security officials claimed that the accused in the case got off the motorcycle at 21:00 and fired at the forces and left the place. The prosecutor presents his documents for this claim. These documents are images from the CCTV camera of a shop in the Khaneh area of Isfahan, which, according to the prosecution’s claim, are proved by these documents that these accused killed two Basij and one Faraja force!

But the CCTV footage only shows a few people standing on the side of the street talking to each other. In these pictures, there is no news of shooting and no weapons are seen! In fact, contrary to the prosecution’s claim, such images can be presented as proof of the innocence of these people!

Another point about these CCTV images is that the first image they show shows the time 21:46 and the second image of the same place and people shows the time 22:09. Even if the people on the CCTV are really the defendants, it doesn’t match the presented scenario! Because the CCTV camera shows that at 22:09 these people were talking on the street. Then, according to this claim, they get on a motorcycle, get off a little further away from the motorcycle, run to the other side of the street, fire at the troops, return, get on the motorcycle, run away, and according to the CCTV footage from the second location, at 10:00 p.m.: 13 They reach their home in another area!

All of this shows that, like many similar cases that were created during last year’s protests with the scenario of the security and judicial institutions in order to put some citizens to death, the documents of the case or confessions were forced and under brutal torture of the accused, which were also denied in the court session, and Or simply the existence of one or two images from CCTV cameras

which absolutely does not indicate the commission of a crime or violation by the defendants!
