جواد روحی؛ محکوم به «سه بار اعدام» بدون اینکه کسی را کشته یا مجروح کرده باشد!

جواد روحی از بازداشت‌شدگان خیزش انقلابی، به اتهام «آتش زدن مقر راهنمایی و رانندگی»، به «سه بار اعدام» محکوم شده است.

کیهان نوین:  جواد روحی در حکمی عجیب که با قوانین ضدبشری خود جمهوری اسلامی نیز تناقض دارد به اتهام «محاربه» و «افساد فی الارض» به دلایلی چون «آتش زدن مقر راهنمایی و رانندگی» و «آتش زدن روسری» به سه بار اعدام محکوم شده است.
وکیل تسخیری: «جواد روحی⁩ مبتلا به بیماری اعصاب و روان است، او در هیچ احراق و تخریبی مشارکت نداشته است. حتی در تصاویر ضبط شده نیز او تنها در صحنه حضور دارد و مشارکتی در اقدامات ندارد.»

جواد روحی جوان معترض ۳۵ ساله که اوایل مهرماه در اعتراضات آمل بازداشت شده بود در حکمی عجیب که حتی با قوانین ضدبشری خود جمهوری اسلامی نیز تناقض دارد، به اتهام «محاربه» و «افساد فی الارض» به دلایلی چون «آتش زدن مقر راهنمایی و رانندگی» و «آتش زدن روسری» به سه بار اعدام محکوم شده است.

بر اساس حکم صادرشده علیه این شهروند توسط دادگاه انقلاب ساری او به دو اتهام «محاربه» و «افساد فی الارض» به «سه بار اعدام» محکوم شده است. جواد روحی اما با اتهامات دیگری نیز در این پرونده روبروست که شامل «اخلال در نظم و امنیت جامعه، تحریک برخی از شهروندان به ایجاد ناامنی، اجتماع و تبانی برای ارتکاب جرم بر ضد امنیت داخلی کشور، ارتداد از طریق هتک حرمت قرآن و آتش زدن آن و همچنین توهین به مقدسات» است.

در حکم صادر شده آمده که تخریب و به آتش کشیدن مقرّ پلیس راهنمایی و رانندگی، اماکن دولتی و نظامی، بانک‌‌ها و شهرداری نوشهر» و همچنین «لیدری و عاملین اصلی هدایت و برنامه‌ریزی» تجمع اعتراضی «روز یکشنبه ۲۰ آذرماه» از دلایل صدور این حکم بوده است.

بنا بر ادعای مندرج در حکم و اظهارات قاضی، تجمع صورت گرفته در ۲۰ اذرماه در نوشهر به کشته شدن «۵ تن و جراحت تعدادی از مأموران» منجر شده است. این در حالیست که در پرونده حتی یک سند و مدرک دال بر اینکه جواد روحی کسی را به قتل رسانده یا مجروح کرده وجود ندارد!

سلیمان وطن‌ دوست وکیل تسخیری جواد روحی هم پیشتر گفته بود که «جواد روحی⁩ مبتلا به بیماری اعصاب و روان است، او در هیچ احراق و تخریبی مشارکت نداشته است. حتی در تصاویر ضبط شده نیز او تنها در صحنه حضور دارد و مشارکتی در اقدامات ندارد.»

جواد  روحی مانند اکثر شهروندان بازداشت‌شده که با اتهامات سنگین روبرو شده‌اند از حق داشتن وکیل «تعیینی» (انتخابی) محروم بوده است. این جوان در حالی به «سه بار اعدام» محکوم شده که دادگستری استان مازندران در ادعایی دروغ گفته که برای جواد روحی «به دلیل عدم معرفی وکیل در مرحله دادسرا و دادگاه، وکیل تسخیری انتخاب شده است».

در کیفرخواست صادر شده علیه جواد روحی، به اعترافات او در دوران بازجویی اشاره شده و به اتکای این اعترافات اجباری، وی به «ساخت کوکتل‌ مولوتف و پرتاب آن به داخل مقر راهنمایی رانندگی میدان آزادی نوشهر که باعث حریق و صدمات جدی به مکان پلیس شده» متهم شده است.

بسیاری از شهروندان بازداشت شده که در روند دادرسی اتهامات سنگین علیه آنها مطرح شده، زیر شکنجه ناچار به اعتراف اجباری و اقرار علیه خود شده‌اند. هرچند برخی متهمان در دادگاه به قاضی گفته‌اند زیر ضرب و جرح و شکنجه اعتراف کرده‌اند، اما قضات یا همان حاکمان شرع انقلاب اسلامی بدون اهمیت به اظهارات متهمان، آنها را به شدیدترین احکام از جمله «اعدام» محکوم می‌کنند.

یک منبع مطلع نزدیک به خانواده روحی نیز پیش از این به خبرگزاری «هرانا» گفته بود «تمامی اعترافاتی که در دوران بازجویی از جواد اخذ شده، تحت آزار و اذیت و فشار اعمال شده بر وی صورت گرفته است. تنها مستندات پرونده علیه وی که منجر به صدور حکم اعدام برایش شده است، اعترافات اجباری اخذ شده از او در دوران بازجویی و همچنین فیلمی از صحنه اعتراضات است؛ ویدئویی که به هیچ عنوان چهره فردی که در آن اقدام به آتش زدن قرآن میکند مشخص نیست، اما دادگاه اقدام مذکور را منتسب به جواد دانسته و او را “مرتد” خوانده است.»

مادر و پدر جواد روحی هفته نخست دی‌ماه و در حالی که فرزندشان به «محاربه» و «افساد فی الارض» متهم شده بود با انتشار ویدئویی اعلام کردند که جواد وضعیت روحی مناسبی ندارد و از مردم ایران کمک خواستند. آنها در این پیام درباره وضعیت فرزندشان که سابقه بیماری اعصاب و روان نیز دارد، اظهار نگرانی کردند و خواستار همیاری و کمک مردم ایران برای نجات او شدند.

پدر این جوان بازداشت شده اعلام کرد که از زمان دستگیری فرزندش، خانواده‌ او تنها یکبار به صورت حضوری او را ملاقات کرده‌ اما از ۲۲ آذر و جلسه محاکمه‌اش تا کنون، از او خبری ندارند. برخی منابع از شکنجه شدن و اعمال فشارهای روانی به جواد روحی برای گرفتن اعتراف اجباری از او اشاره کرده‌اند.

آنها در پیام خود، درباره وضعیت فرزندشان صراحتا اعلام کردند که او سابقه بیماری اعصاب و روان دارد و در زمان حضور در اعتراضات و بازداشت نیز، تحت درمان بوده است.

دادگاه انقلاب استان مازندارن پیشتر نیز برای دو جوان ۱۸ ساله دیگر حکم اعدام صادر کرده بود. مهدی محمدی‌‌فرد نوجوان ۱۸ ساله‌ای است که در جریان اعتراضات سراسری در نوشهر بازداشت شده و توسط شعبه اول دادگاه انقلاب ساری، به اتهام «افساد فی‌الارض» و «محاربه»، به «دو بار اعدام» محکوم شده است.

عرشیا تکدستان نیز جوان ۱۸ ساله دیگری است که در نوشهر بازداشت و توسط دادگاه انقلاب، به جرم «محاربه و افساد فی‌الارض» به اعدام محکوم شده است.

در جنبش انقلابی اخیر که از اواخر شهریور ۱۴۰۱ آغاز شده تا کنون بیش از ۱۹ هزار و ۲۰۰ شهروند بازداشت شدند. به گزارش «سازمان حقوق بشر ایران» دست‌کم ۱۰۹ معترض در ایران در خطر صدور یا اجرای احکام اعدام قرار دارند.

بر اساس این گزارش، در استان خوزستان، دست‌کم ۲۴ معترض، در سیستان و بلوچستان، ۲۲ معترض و در تهران، ۲۰ معترض بازداشتی در معرض خطر صدور یا اجرای حکم اعدام هستند.

محسن شکاری ۲۳ ساله، مجیدرضا رهنورد ۲۳ ساله، محمدمهدی کرمی ۲۲ ساله و محمد حسینی ۳۸ ساله شهروندانی هستند که حکم اعدام آنها اجرا شده است. درخواست فرجام‌خواهی شماری از متهمان محکوم به اعدام از سوی دیوان عالی کشور پذیرفته شده و پرونده به دادگاه هم‌عرض ارسال شده اما همچنان شهروندان زیادی در زندان‌های جمهوری اسلامی در بیم و امید نسبت به سرنوشت خود بسر می‌برند.

According to the verdict issued against this citizen by the Sari Revolutionary Court, he has been sentenced to “three times of execution” for the two charges of “warfare” and “corruption on earth.” Javad Rouhi is also facing other charges in this case, which include “disturbing the order and security of society, inciting some citizens to create insecurity, gathering and conspiring to commit crimes against the internal security of the country, apostasy through desecration of the Quran and arson.” It is also an insult to the holy things.

The decree issued states that the destruction and burning of the traffic police headquarters, government and military places, banks and Nowshahr municipality, as well as the “leaders and main actors of the planning and directing” of the protest rally on Sunday, December 20, are among the reasons for issuing this decree. It was a verdict.

According to the allegation contained in the verdict and the judge’s statements, the gathering that took place on 20th of Azhar in Nowshahr resulted in the death of “5 people and the injury of a number of officers”. This is while there is not even a single document in the case indicating that Javad Rouhi killed or injured anyone!

Suleiman Watan Dost, the lawyer of Tashkir Javad Rouhi, had previously said that “Javad Rouhi is suffering from a mental illness, he did not participate in any arson or destruction.” Even in the recorded images, he is only present on the scene and does not participate in the actions.”

Javad Rouhi, like most of the detained citizens who have faced heavy charges, has been deprived of the right to have an “appointed” (chosen) lawyer. This young man has been sentenced to “three executions” while the Mazandaran provincial judiciary lied in a claim that “a substitute lawyer was chosen for Javad Rouhi due to the lack of introduction of a lawyer at the prosecutor’s office and court stage”.

In the indictment issued against Javad Rouhi, his confessions during the interrogation are mentioned, and based on these forced confessions, he made a Molotov cocktail and threw it into the traffic control headquarters in Azadi Square, Nowshahr, which caused a fire and serious damage to the police station. He has been accused.

Many of the arrested citizens, who have been charged with serious charges during the trial, have been forced to confess under torture. Although some of the defendants told the judge in court that they confessed under beatings and torture, the judges or the rulers of the Islamic Revolution, regardless of the statements of the defendants, condemn them to the most severe sentences, including “death”.

An informed source close to Rouhi’s family had previously told “Harana” news agency, “All the confessions obtained from Javad during the interrogation were made under harassment and pressure.” The only documentation of the case against him that led to his death sentence are the forced confessions obtained from him during the interrogation and also a video of the protest scene; “The video in which the face of the person trying to set fire to the Quran is not clear, but the court attributed the act to Javad and called him an apostate.”

In the first week of January, while their son was accused of “warfare” and “corruption on earth,” the mother and father of Javad Rouhi released a video and announced that Javad was not in a good mental state and asked the people of Iran for help. In this message, they expressed concern about the condition of their son, who has a history of mental illness, and asked for the cooperation and help of the people of Iran to save him.

The father of this arrested young man announced that since his son’s arrest, his family has met him only once in person, but they have not heard from him since 22 Azar and his trial until now. Some sources have mentioned that Javad Rouhi was tortured and psychologically pressured to get a forced confession from him.

In their message, they clearly stated about their son’s condition that he has a history of mental illness and was being treated during the protests and detention.

The Revolutionary Court of Mazandaran province had previously issued a death sentence for two other 18-year-old youths. Mehdi Mohammadifard is an 18-year-old teenager who was arrested during nationwide protests in Nowshahr and was sentenced to “twice execution” by the first branch of the Sari Revolutionary Court on the charges of “corruption in the land” and “moharebeh”.

Arshiya Takdestan is another 18-year-old youth who was arrested in Nowshahr and sentenced to death by the Revolutionary Court for the crime of “war and corruption of the land”.

In the recent revolutionary movement that started at the end of September 1401, more than 19,200 citizens were arrested. According to the “Iranian Human Rights Organization”, at least 109 protesters in Iran are in danger of issuing or executing death sentences.

According to this report, in Khuzestan province, at least 24 protesters, in Sistan and Baluchistan, 22 protesters and in Tehran, 20 protestors are in danger of issuing or executing the death sentence.

23-year-old Mohsen Shekari, 23-year-old Majidreza Rahnavard, 22-year-old Mohammad Mahdi Karmi and 38-year-old Mohammad Hosseini are the citizens whose death sentences have been executed. The appeal request of a number of defendants sentenced to death has been accepted by the Supreme Court and the case has been sent to the same court, but still many citizens in the prisons of the Islamic Republic are in fear and hope for their fate.
